Terms of Service

By using RiverStoke ("the Service"), you agree to these terms. If you don't agree, please don't use the Service.
1. The service
RiverStoke is a logbook and planning tool for paddlers — kayak, raft, canoe, SUP, packraft. It's provided "as is" for personal, non-commercial use. We may add, remove, or change features at any time.
2. Eligibility
- You must be at least 13 years old.
- You agree to provide accurate account information.
- You're responsible for keeping your password secure.
3. Your content
You own everything you upload (trips, photos, journal entries, gear, recipes). You grant RiverStoke a limited license to host, display, and process that content as needed to provide the Service — and to share it according to the privacy setting you chose for it.
Submitting a recipe to the Community catalog grants RiverStoke a perpetual, non-exclusive license to keep it in the catalog even if you later delete your account (so other paddlers' trip plans that reference it don't break).
4. Acceptable use
Don't:
- Harass, threaten, or harm other users
- Upload content you don't have the rights to (someone else's photos, copyrighted material)
- Spam, scrape, or attempt to abuse the Service infrastructure
- Misrepresent yourself or impersonate someone else
- Upload illegal content or facilitate illegal activity
- Reverse-engineer or otherwise circumvent the Service's security
We may suspend or terminate your account if you violate these.
5. Whitewater paddling is dangerous
RiverStoke provides information, not advice or guidance. River conditions change rapidly. Sections classified as a given difficulty may be more or less dangerous depending on flow, weather, gauge accuracy, time of year, and a hundred other factors we can't know. Permit requirements, access restrictions, and seasonal closures change frequently.
You are responsible for:
- Verifying that the section you're paddling is within your skill level today, at the current flow
- Checking current permit and access status with the official agency (NPS, BLM, USFS, state, etc.) — not relying on RiverStoke's listing
- Carrying appropriate safety gear, communicating your trip plan, and paddling with appropriate company
- Your own safety and the safety of your crew
6. Disclaimer of warranties
The Service is provided "as is" and "as available." We disclaim all warranties to the maximum extent permitted by law — express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, accurate, or error-free.
7. Limitation of liability
To the maximum extent permitted by law, RiverStoke and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages — including (but not limited to) bodily injury, death, property damage, loss of data, or loss of profits — arising from your use of the Service.
Our total liability for any claim arising from the Service is limited to the amount you've paid us in the 12 months preceding the claim. The Service is currently free; that number is, mathematically, zero.
8. Indemnification
You agree to indemnify RiverStoke against claims arising from your use of the Service or your violation of these terms.
9. Termination
You may close your account at any time from your profile settings (or by emailing hello@riverstoke.com). We may suspend or terminate your account for violations of these terms or for inactivity exceeding 5 years.
10. Changes to these terms
We may update these terms. Material changes will be announced via email to active users at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
11. Governing law
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Colorado.
